S6.26 26-0612 Subject: Illegal Dumping Expenditure Plan From: Oakland Public Works Department Recommendation: Adopt A Resolution Acknowledging The Urgency And Expediting Actions To Remedy Illegal Dumping Through An Illegal Dumping Expenditures Action (IDEA) Plan (1) Authorizing The City Administrator To (A) Implement The IDEA Plan By Negotiating And Entering Into Contracts, Grant Agreements, And Expenditures As Set Forth In Table 1 In A Total Amount Not To Exceed $1,100,000; And (B) Pursue Partnerships With County, Regional And/Or State Agencies To Enhance These Efforts; (2) Waiving, To The Extent Necessary, The City's Advertising, Competitive Bidding And Multi-Step Technology Acquisition Requirements For The Contracts; And Waiving The Local /Small Local Business Enterprise Program Requirement For The Big Truck Rental (Lightning Loader) Contract; (3) Appropriating And Allocating An Amount Not To Exceed $1,100,000 From Budgeted Funds In Fund 1720, Comprehensive Cleanup Fund, For These Purposes; (4) Accepting And Appropriating Additional Funds From Public And Private Sources And Authorizing The City Administrator To Actively Seek And Apply For Such Funds And To Amend Existing Contracts And/Or Enter Into New Contracts Consistent With The Purpose Of This Resolution And In Furtherance Of The Plan In A Total Amount Not To Exceed The Value Of Such Additionally Appropriated Funds; And (5) Directing The City Administrator To Return To Council Within One Year Of The Adoption Of This Resolution To Provide An Informational Report On Actions Taken, Funds Received And Expended, And Contracts Awarded Pursuant To This Plan And The Authority Granted By This Resolution

    Dear Councilmembers and CM Staff,

    I urge you to pull Item S6.26 (File ID 26-0612: $1.1M IDEA Plan) from Tuesday’s Consent Calendar for open debate and oversight amendments.

    A city's budget is a statement of values. For residents facing daily illegal dumping, value means clean streets, not just fast spending. Passing this on Consent creates an oversight vacuum due to a glaring asymmetry in "urgency":

    1. Urgent Spending: The city is waiving competitive bidding and technology procurement rules to fast-track $1.1M to private vendors immediately.
    2. Delayed Accountability: Conversely, Public Works has zero urgency for verification, stating actual KPIs won't be ready for a year. They shouldn't write the definition of success retroactively.

    This risk is magnified by the City Auditor’s April 23rd Performance Audit, which cited Public Works for a systematic failure to track enforcement data.

    Please pull S6.26 and amend the resolution, or issue a binding Staff Direction to the City Administrator, to mandate that clear metrics be established before funds are dispersed, followed by public progress updates at 30, 60, and 90 days, shifting to quarterly thereafter.
