5 25-0757 Subject: Issuance Of An Unconditional Certificate Of Completion For Brooklyn Basin Phase Two Public Improvements

Recommendation: Adopt A Resolution Accepting Public Infrastructure Improvements, Directing The Filing Of An Unconditional Certificate Of Completion (UCC) For The Brooklyn Basin Phase Two Improvements Per The Subdivision Improvement Agreement ("SIA") For Deferred Construction Of Public Infrastructure Improvements, And Making California Environmental Quality Act ("CEQA") Findings
The city and developer were previously coordinating on Class IV separated bikeway installations on Embarcadero (5th Ave to 10th Ave) and on 5th Ave (Embarcadero to E 8th). Plans were drawn up in 2019 but the coordination stalled and they were never able to move it to construction.
Bike East Bay and others advocated for this work to be included as a condition of development for the last Brooklyn Basic permitting update in 2023, which council members mentioned but did not to mandate during the deliberations.
OakDOT staff have still expressed interest in these bikeway upgrades, since the Bay Trail segments incorporated into the development are oriented for recreational but not transportation needs.
With a new Class IV separated bikeway now installed on 7th / E 8th St between Fallon and 5th Ave, and a 2-way cycletrack coming to Oak Street within the next few years, a continuous connecting route on 5th Ave and Embarcadero could help provide a seamless and low-stress bikeway connection between Brooklyn Basin and Lake Merritt BART, in addition to many more destinations.
We now encourage the city to continue seeking opportunities to deliver the on-street separated bikeway infrastructure on their own, separate from the developer conditions. Measure U-funded paving on 5th Ave scheduled in 2026 is an excellent opportunity to deliver these long-delayed improvements.
