5.16 25-0571 Subject: Amendment To Oakland Municipal Code Chapters 5.80 And 8.30

Recommendation: Adopt An Ordinance: (1) Amending Oakland Municipal Code Chapters 5.80 And 8.30, Respectively By: (A) Establishing Standards For The Approval Of Onsite Consumption Permits For Cannabis Smoking; And (B) Exempting Such Onsite Consumption Permits From The City's Indoor Smoking Restrictions; And (2) Making Appropriate California Environmental Quality Act Findings
On behalf of Oakland’s cannabis community, Cal NORML wishes to state our strong support for the proposed ordinance to permit cannabis smoking at licensed consumption rooms (Item 5.16, May 6th agenda).
Opponents are wrong to assert that second-hand cannabis smoke is as dangerous as tobacco. Not a single study has demonstrated human harm from second-hand exposure to cannabis smoke.
• Unlike tobacco, first-hand cannabis smoke has been determined NOT to cause lung cancer in users, according to the National Academy of Sciences.
• Just last week, a new study reported that unlike tobacco, cannabis smoking is not associated with emphysema or coronary artery calcification.
• In light of such evidence, it is all the less likely that second-hand exposure to cannabis smoke poses similar harms as tobacco.
• Regardless of what one thinks of the science, no one who dislikes cannabis smoke will be harmed by the proposed ordinance. Only persons who willingly choose to patronize or work at licensed consumption rooms will be exposed to cannabis smoke.
Oakland stands to benefit from allowing cultural diversity for cannabis users and businesses. Cal NORML accordingly urges you to support the proposed ordinance.
About time we had consumption lounge permits in Oakland. This will make the cannabis scene here that much more current and competitive and better.
