6.7 23-0428 Subject: Salary Ordinance Amendment For City Attorney And City Auditor

Recommendation: Adopt An Ordinance Amending The Salary Schedule Of Ordinance No. 12187 C.M.S. ("Salary Ordinance") To Increase The Salary For City Attorney And City Auditor
Oakland Mayor Sheng Thao released a memo to the Oakland City Council that encouraged the body to set her salary increase at the lowest level possible. Well, that's nice, but her action is illegal per the Oakland City Charter.
The Oakland City Charter is clear:
2.25.040 - Conflicts of interests and personal gain.
A.
Financial Conflicts of Interests. A Public Servant shall not make, participate in making, or seek to influence a decision of the City in which the Public Servant has a financial interest within the meaning of the California Political Reform Act, Government Code Section 87100 et seq. and pursuant to City Charter Section 1200. All provisions of California Government Code Section 87100 - 87505 and City Charter Section 1200, as they relate to Public Servants, are incorporated by reference into this Act.
Sheng Thao's Memo Clearly Falls Into Illegal Territory
Is anyone telling Sheng not to do these things? What is going on here?
No salaries for upper management such as City Attorney and City Auditor or Mayor should be increased at this time, till we are more financially stable. Currently there are other needs the city should be considering allocating these funds that are really affecting the health and vitality of the City and its citizens well-being. Hire more environmental officers, hire more CRO's or donate it to organizations doing community policing, that would be more beneficial right now! They are already 6 figure earners they can hold on a little longer for their pay raises!
