10 22-0849 Subject: Cultural Conservation Easement To Sogorea Te' Land Trust In Joaquin Miller Park From: Economic Workforce Development Department, Office Of The Mayor, & Pro Tem Thao Recommendation: Adopt An Ordinance (1) Granting A Cultural Conservation Easement Over An Approximately 5-Acre Portion Of Joaquin Miller Park Known As Sequoia Point To The Sogorea Te' Land Trust (Grantee), At No Cost, To Preserve And Enhance The Cultural, Historic, Educational, Natural Resource, Scenic, And Open Space Values Of The Easement Property In Perpetuity; And (2) Authorizing The City Administrator To Negotiate And Enter Into A Memorandum Of Agreement For The Implementation Of The City Of Oakland's Reserved Rights And The Grantee's Rights And Obligations Under The Conservation Easement, And To Amend Said Memorandum Of Agreement Without Returning To Council; And (3) Amending The Oakland Municipal Code To Add Section 12.64.420 To Authorize The Use Of Parks By Recipients Of Conservation Easements Without Obtaining Park Permits; And (4) Making California Environmental Quality Act Findings[TITLE CHANGE]

    I urge the City of Oakland to return Sequoia Point to Sogorea Te’ Land Trust and the Lisjan Ohlone people. I fully support granting this easement to rematriate this land to its original caretakers.

    Please give this land to Sogorea Te Land Trust. I fully support giving land back to the Indigenous peoples that we (as a city and country) have taken so so much from.

    There are a number of Ohlone organizations in this area which should be consulted concerning this easement. The Native American Heritage Commission is available to provide a list of Most Likely Descendants of the Joaquin Miller Park Area, which the City of Oakland has a duty to use to contact Ohlone Organizations, including the Muwekma Ohlone Tribe of the San Francisco Bay Area--which is the Formerly Federally Recognized Ohlone Tribe [read: sovereign nation] of this area. This is especially important considering the fact that this easement would give rise to a Public Project; which the City is bound [legally required] to reach out to the proper tribe by law, according to the California Environmental Quality Act, and the Native American Graves Protection and Repatriation Act for any public project on Native Land. At the very least, the City of Oakland needs to contact the Most Likely Descendants of Joaquin Miller Park to offer them all an equal share of interest in this property/project/easement.

    The presence and work of the Sogarea Te’ Land Trust is invaluable to the communities of the Bay Area. I fully support the returning of this land to indigenous stewardship.

    I support granting an easement on Sequoia Point to Sogorea Te’ Land Trust. No one knows how to better care for this land in Huichin than Lisjan Ohlone people. Rematriate the land!

    This is a historic moment and a rare opportunity in a political career to have influence in a decision that would return land back to the original People and stewards of this land. I urge you to make this your legacy and vote to support the return of Sequoia Point to the Lisjan Ohlone community.

    It is so important that the Lisjan people are given back some of what has been theirs all along. The Lisjan people deserve to have this loan for land restoration and cultural practices. Outside of this being so significant for the local Indigenous communities, it has the potential to set a powerful example for other places across the continent. Please support stolen land being returned to its rightful stewards. Thank you.

    As an Oakland resident, voter, and community member I urge the council to return Sequoia Point to the Lisjan Ohlone community. In the words of Corrina Gould, “This agreement with the City of Oakland will restore our access to this important area, allowing a return of our sacred relationship with our ancestral lands in the Oakland hills. The easement allows us to begin to heal the land and heal the scars that have been created by colonization for the next seven generations.”
