3.3 22-0161 Subject: Delinquent Business Tax Assessment Of Liens

Recommendation: Conduct A Public Hearing And Upon Conclusion Adopt One Of The Following Pieces Of Legislation:
1) A Resolution Accepting And Confirming Reports Of The City Administrator On The Costs Incurred By The City Of Oakland For Delinquent Business Taxes And Confirming The Recordation Of Liens With Administrative And Assessment Charges As Necessary Pursuant To Chapter 5.04 Of The Oakland Municipal Code, And Directing The Notice Of Lien And Assessment Charges Be Turned Over To The County Tax Collector For Collection; Or
The City is trying to impose taxes going back to 2005 through the present on a Property that was our residence for part of that time, and it makes false assumptions of amounts of rent collected. It is also levying late fees/penalties based on these false assumptions, and did not notify us of same until 2020, fifteen years after we purchased the Property. It is patently unfair, and we need to have an accounting in order to appeal this unfair assessment. (acct 00234356)

We have tried to obtain an accounting of the proposed lien fees by contacting the Tax Compliance Section via their email (BTLiens@Oaklandca.gov) without success. We cannot properly appeal the assessment without this information. The first notice received regarding the proposed lien was a Final Notice received in Sept. 2021. We had not received anything before that time. Since that time, we have tried repeatedly to obtain this information in order to determine whether it is based on incorrect information.
