2 22-0044 Subject: Cure and Correct - Proof of Vaccination Emergency Ordinance

Recommendation: For Cure and Correct Consideration, Pursuant to Government Code Section 54960.1, to Rescind and Re-Adopt an Emergency Ordinance Adopted at the December 21, 2021 Council Meeting, Adding Oakland Municipal Code 8.68 To Require Proof of a Covid-19 Vaccination For Patrons At The Following Indoor Public Locations: (1) Establishments Or Events Where Food Or Drink Is Served Including Restaurants, Bars, Coffee Houses, Clubs, And Banquet Halls; (2) Entertainment Venues, Theaters, Concert Venues, Museums, And Recreation Facilities; (3) Gyms, Fitness Centers And Yoga Studios; (4) Senior Adult Care Facilities And City Senior Center Programs; (5) City Hall; And (6) Large Indoor Events At City And Privately-Owned Facilities
My daughter (12 years) will be competing in an indoor rock climbing youth divisional competition on Feb 12/13th at the Pacific Pipe gym in Oakland.
The short timeframe doesn’t give us enough time to have her fully vaccinated in order to compete. She will also be competing with 11 year olds from other states in her category that do not require proof of vaccine. Proof of vaccine also doesn’t guarantee that the patron/athlete is symptom free and fit to compete. Wouldn’t a negative test be sufficient and more effective in this event to ensure the athletes are healthy to compete and to reduce the possibility of any spread of the virus?
I truly believe (and request) with negative PCR/antigen test for unvaccinated patrons stills falls within the city’s guidelines to protect and prevent the spread of the virus in this pandemic.
It seems like a bit of a double standard. Is this the message the city wants to send? The law is for thee but not for me? All the business venues have the same problems- they are trained for this, they don't want to be confrontational, and they really, really don't want to turn away customers. This is an uncomfortable situation.
