Recommendation: Adopt A Resolution Endorsing AB 15, The Tenant Stabilization Act Of 2021, And Urging Governor Newsom And The California State Legislature To Pass Assembly Bill 15 With Urgency, Without Preemption Of Critical Local Protections, Allowing City And County Governments To Address The Effects Of The Covid-19 Pandemic And Stabilize Their Communities
Tenants and landlords BOTH need confidence that their government isn’t out to destroy them. That appears to be the relentless agenda of this city council- exclusively for the mom and pop owner. Small landlords are Oakland’s saviors. They offer the real affordable housing in this town. These people cannot be intentionally excluded from protections and consistently singled out to carry the burden in this mandated emergency. They aren’t any better off than you are.
Think before you act- unintended consequences abound. The outcome will be foreclosure, displacement and more ill will.
There is no doubt protections for tenants who have lost income due to COVID are necessary. Equally, the city council must also acknowledge that many small and minority landlords will lose their hard-earned rental properties when this extension is adopted. Not to make a statement acknowledging this fact is irresponsible and a failure to represent all its constituents.
The City of Oakland supports NEW America, a non profit working in the Oakland to teach minorities and immigrants to save money and build wealth. Oakland is doing nothing to protect small and minority landlords from loosing the only chance they may have had at building family wealth when they invested in a piece of the American dream. What an irony.
This bill should allow evictions for tenants who are destroying properties. It does not. It tells tenants to call any attempt to do so retaliation for not paying rent. It absolves any tenant of responsibility to treat a rental property with respect. The law's stated purpose is to keep evictions down so people don't move in together and worsen the COVID-19 situation. The TPO as passed here in Oakland encourages doing that right up to the max provided by state law.
