Recommendation: Adopt An Ordinance Amending Chapter 2.29 Of The Oakland Municipal Code Entitled "City Agencies, Departments And Offices" To Create The Department Of Workplace And Employment Standards Focusing On Workplace Protections And Employment Standards To Implement Measure Z (Hotel Minimum Wage And Working Conditions Ordinance (Oakland Municipal Code Chapters 5.93 And 2.44 And Sections 2.36.010(A) And 5.92.050).
City Council should stand up the new Department of Workplace and Employment Standards (DWES), as required by Measure Z which was approved by Oakland voters in 2018. As a worker in Oakland I feel like we need a space that will actually be helpful to uphold the laws that protect my rights and the rights of every worker here in Oakland. So many people worked hard to get measure Z passed. Please stand up for Oakland voters and get the Department of Workplace and Employment Standards up by the July deadline by passing these ordinances (items 4 & 5).

The Restaurant Opportunities Center of The Bay receives wage claims left and right from workers that go answered or take so long to be answered at the state level that workers often find their only alternative is to leave their jobs. Our workers deserve more.

Through my conversations over the years with hundreds of workers in Oakland, it is clear that the town is in urgent need of this department. Measure Z mandates establishment of the Dept. by July 1, 2020. The state DLSE estimates that the City’s current office has a backlog of 2-2.5 years for wage claims. This is unacceptable. COVID demonstrates that our lowest paid workers are our most essential. A strong Dept will ensure robust enforcement of the law and assistance to both workers and employers. While Oakland has been a leader in establishing strong labor standards, workers continue to experience violations of their rights due to the lack of real and effective enforcement. The workers most impacted by these violations are the same folks our City claims to protect and to welcome. Oakland demands a Department that protects its most vulnerable workers and businesses deserve a level playing field where everyone follows the law. Workers’ rights are civil and human rights. I encourage you all to VOTE YES. Finally, I encourage and expect swift implementation by our Mayor.

As the Political Director of Oakland Rising, I am strongly demanding the City Council to pass the creation of the Dept. of Workplace & Employment Standards as required my Measure Z that was passed by a majority vote in Oakland in 2018. This is the moment to finally put into fruition what the voters of Oakland asked for almost two years ago - protections of workers and an oversight and enforcement of those protections. The time is now while so many of our workers in limbo and in precarious positions. We knew in 2018 that these protections and this department was necessary and now we see that when crisis hits, those you bear the brunt are our hourly and low-wage workers. Step up and protect our workers today and be the shining example we continue to tout ourselves to be - a city that protects our most vulnerable and ensures that our workers are protected.
