4 20-0338 Subject: Flavored Tobacco Loophole Municipal Code Amendments From: Vice Mayor Reid, Pro Tem Kalb, Councilmembers Taylor And Thao Recommendation: Adopt An Ordinance Changing Local Rules For The Sale Of Tobacco Products By: (A) Amending Oakland Municipal Code Chapter 5.91 To: (1) Eliminate The "Tobacco Store" Exception To The City's General Prohibition On The Sale Of Flavored Tobacco Products; (2) Prohibit Pharmacies From Selling Tobacco Products; (3) Impose A Minimum Price And Package Size For Cigars And Cigarettes; (4) Require The On-Site Purchase Of Tobacco Products; (5) Change Definitions Of Terms; (6) Make Administrative Changes For The Licensure Of Tobacco Retailers; And (B) Repealing Oakland Municipal Code Chapter 8.34, Which Prohibits Tobacco Product Vending Machines In Areas Accessible To People Under Twenty One (21) Years Of Age

    This store has a variety of different things other than tobacco. I come to this store daily in our urban community we dont have alot of resources as we should but this store is one of them I pick up tissue, paper towels and a variety of other things everyone doesn't have the luxury of a vehicle to get from place to place to get thing you may need.

    I am writing to oppose the flavored tobacco ban. I do not participate in tobacco usage, but I don't agree with banning an adults' right to use flavored tobacco. A person 18+ can make the decision to fight for their country and possibly perish or come back with ptsd, but a person 21+ can't make their own decision to use tobacco? Sweet foods dependent on how much consumed can cause obesity or diabetes that can lead to death are not banned, but instead added a sugar tax. Prescribed drugs that has deadly side effects or can cause addiction are not banned. Alcohol not only causes danger to thyself but others if a person operates heavy machinery is not banned. Everything is a personal choice. I like sweets and you may not like sweets, but does that indicate I'm wrong for liking it? No. If adults don't like it, the companies wouldn't be in business to produce, as is with any other product. It's unconstitutional to take away an adults' right to flavored tobacco use because it's their RIGHT.
