9.2 18-2386 Subject: Appeal Of The Planning Commissions Decision On 1630 10th Street

Recommendation: Conduct A Public Hearing And Upon Conclusion Adopt One Of The Following Pieces Of Legislation;
1) A Resolution Denying The Appeal By The Concerned Prescott Parents Committee (PLN18388-A01) And Upholding The Planning Commission's Decision To Approve A Minor Conditional Use Permit And Environmental Determination To Establish A Health Care Civic Activity At 1630 10th Street (PLN18388); Or
I support the appeal of the Concerned Parents of Prescott. The school already suffers adverse effects from the food distribution that occurs at 1630 10th St several days per week: customers smoking outside classroom windows, garbage piling up beside the kindergarten playground, customers sneaking onto campus to use the restroom and then blocking security doors open so others can have access. The diocese has been unresponsive to our complaints.
Young children need to be protected from the increased drug marketing that will inevitably occur when the local drug dealers notice new potential clients in the area. The police have proven incapable of controlling dealing around the school. It is absurd for Options' supporters to claim that they will be able to positively influence the local drug dealing in West Oakland the way they supposedly did in a very different neighborhood in Berkeley. There is a good chance this facility will result in deterioration of the surrounding neighborhood.
I support the appeal of the concerned parents of Prescott, this important program should not be placed across the street from an elementary school. Prescott students deserve the same protections and care as those in more affluent neighborhoods, to whom this would NEVER happen. Uphold the appeal and work with the respondents to find an alternative location for their important program.

I submit that Options Recovery Services would best serve the diverse 94607 area thus fulfilling the terms of their Alameda County contract by continuing to operate at 610 16th Street Suite 312, Downtown Oakland, which has numerous transit options and provides the necessary discretion for clients being services, during all hours.
